An Ogre Bushi is attacking my Provinces, and I have a Bayushi Kachiko InexpCoM at home. My opponent plays Breaking the Rhythm on his Ogre, removing the 1f Penalty. He is then sent home and moves in again. Does Kachiko attempt to give the penalty again (he is now attacking) or because he was always a Nonhuman does it not reapply?

The -1F is continuously applied on Nonhumans, it is not dependent on it attacking you, so being sent home doesn't cause the effect to end, it is always the same effect. Therefore it is not a new effect and the penalty won't reassert itself. (Same applies to Fallen)
