Ok, I attack. My opponent plays surprise attack. For the surprise attack "battle," am I still considered the Attacker since it's my attack phase or is he the attacker since he played the surprise attack?

Yes. It creates a new battlefield and moves units there. It does nothing to attacker / defender status.
