Bayushi Nomen + Being targeted while not in an army

A topic from AEG's L5R CCG Rules forum, copied for Oracle of the Void from a copy of the forum saved in October 2015, so pages it didn't save are missing. HI there,

"Bayushi Nomen 3F/4C 5HR 5G 2PH Scorpion Clan • Samurai • Courtier Actions performed by Personalities who were dishonorable when the action was announced cannot target Nomen or Personalities in Nomen’s army." [MRP, Samurai Edition, 25 July 2007]

Can i target Bayushi Nomen with an action performed by a dishonorable personality while he is not on an army? For sake of example Can i use Bayushi Saya's open ability to target a Bayushi Nomen, if she is Dishonorable when i annouce it?

I tried to look up this on the Comprehensive Rules Wiki Site, but found the information a bit hard to understand/apply to Bayushi Nomen's scenario (there is no a in Nomen's Trait so w use the 3rd paragraph and the answer to my question is Yes ?) http://rules.l5r.com/Special_wording_rules#Conjunctions mainly on 3rd paragraph vs the 6th :

Modifiers attached to a phrase in the form of "a [modifier] X or Y" or "a [modifier] X and Y" modify both things in that phrase. Example: "A Shadowlands Shugenja or Monk" means "a Shadowlands Shugenja or a Shadowlands Monk." If "a Monk or a Shadowlands Shugenja" is meant, it will be written that way. Likewise, "a Shugenja or Monk without attachments" means "a Shugenja without attachments or a Monk without attachments."

Modifiers attached to a phrase in the form of "a [modifier] X or a Y" or "a [modifier] X and a Y" modify only the first thing in the phrase; they do not carry over the "a." Example: "A Shadowlands Shugenja or a Monk" does not imply that the Monk has to be Shadowlands.

Thanks for the help!

No, you can not.

I realize that a strict application of the Conjunction Rules makes his trait read, "...can not target Nomen in Nomen's army or Personalities in Nomen's army." But "can not target Nomen in Nomen's army" doesn't make a lot of sense, and it isn't how such a trait would be written if it were just on its own. Sometimes one has to rule based on the most sensical interpretation and by taking a look at the broader picture.

So, in summation, Bayushi Nomen (basic) is always an illegal target for actions performed by Personalities who were dishonorable when the action was announced, no matter what his location.
