Normally I would think such a thing preposterous, but I seem to recall Moshi Sakae in Lotus being able to make Ranged Attacks when dead, yea, even when removed from the game. My question is, if Isawa Ochiai xp uses her Open action, then is destroyed, can she issue her challenge from the discard pile?

No. http://rules.l5r.com/Challenges_and_duels: "A challenge is an effect that can create a duel: an individual confrontation between two personalities controlled by different players." Nobody controls Ochiai, so the duel does not occur.
